Condițiile achiziției

Înaintea de a achiziționa accesul la oricare dintre abonamentele sau cursurile noastre trebuie sa înțelegeți si sa va dați acordul ca:

Aveți acces la un PC, Laptop sau un alt dispozitiv (tableta sau telefon) pe care operează un motor de căutare si cu care puteți citi documente si viziona si asculta video. Motoarele de căutare compatibile cu Serviciile noastre sunt Chrome, Firefox, si Safari

Aveți o conexiune la internet în bandă largă, care să ofere lățime de bandă și viteze de conectare capabile să transmită în flux video.

Trebuie să cooperați cu noi în legătură cu acest acord; și tot ce este necesar pentru a accesa informațiile furnizate de noi; pentru a furniza Serviciile, inclusiv, dar fără a se limita la, texte complete, documentație, informații și elementele necesare care nu sunt dezvoltate de noi.

Putem transfera sau atribui acest Contract unei terțe părți.

În cazul în care Achiziția nu este decontată de angajatorul dumneavoastră acest acord reprezintă un contract încheiat între noi si dumneavoastră.

În cazul în care Achiziția este decontată de angajatorul dumneavoastră, sunteți de acord pentru a furniza angajatorului dumneavoastră informații privind progresul si performanța dumneavoastră la cursul/cursurile/testele la care sunteți înscris.

You represent and warrant that:

(i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that

(ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide it to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Purchase Conditions

Before you purchase access to any of our memberships or courses, you need to clarify and agree to the following:

You must have access to a PC, Laptop or smart device (tablet or phone) with a suitable commonly used browser and the capability to view documents and to view and listen video. Compatible browsers include supported versions of Chrome, Firefox and Safari.

You must have a Broadband Internet connection providing bandwidth and connection speeds capable of streaming video.

You must cooperate with us in relation to this agreement; and all necessary to access such information provided by us; to provide the Services, including but not limited to complete texts, documentation, information and the required items that are not developed by us.

We may transfer or assign this Agreement to someone else.

You cannot transfer a course to another student or anybody else. You are therefore not allowed to share any content provided nor can you provide access to our service to any third party through your account.

You cannot transfer to a different course or membership.

Unless your Employer sponsors you, it is implied that this contract would be held legal between you and us.

If your Purchase is paid by your employer you agree us to provide to your employer data regarding your progress and performance on the course/courses/tests you are enrolled with us.

Materialele de curs nu pot fi considerate exhaustive cu privire la subiectele prezentate și vor fi avute în vedere numai prin raportare la data indicată în cuprinsul lor ca moment de referință al aplicării legislației pe baza căreia au fost elaborate si la cerințele examenului pentru care au fost elaborate. Crearea contului nominal

În vederea înscrierii la oricare dintre cursuri, este necesară crearea unui cont nominal pentru utilizarea Serviciilor, securizat printr-o parolă aleasa de către utilizator.

În vederea creării contului nominal, utilizatorul declară, garantează și își asumă că îndeplinește cumulativ următoarele cerințe:

a)     a împlinit vârsta de 18 ani;

b)     a utilizat, pentru crearea contului nominal date de identificare complete și reale și va notifica Furnizorului modificarea oricăreia dintre aceste date;

c)     adresa de e-mail declarată pentru crearea contului nu este o adresă folosită de mai multe persoane

d)     adresa de e-mail declarată pentru crearea contului este o adresă personala la care nu are acces nicio altă persoană;

e)     nu va încărca, promova sau transmite în alt mod nici un fel de mesaje sau comunicări comerciale nesolicitate sau orice formă de ofertă comercială prin intermediul Serviciilor;

f)      nu va redacta sau furniza în alt mod nici un fel de mesaje jignitoare, rasiste, false, înșelătoare, defăimătoare sau altele asemenea;

g)     va păstra confidențiale datele de acces și nu va facilita accesarea neautorizată de către nicio altă persoană la oricare dintre Servicii;

h)     nu va introduce niciun virus sau o altă tehnologie similară care poate sau este destinată să aducă atingere bunei funcționări a Serviciilor sau a oricăror resurse hardware sau software ale Furnizorului sau ale altor utilizatori.

Nerespectarea acestor condiții este echivalentă cu nerespectarea Termenilor si Condițiilor si, prin urmare, considerăm că încetează accesul dumneavoastră la Servicii.

Vă obligați să ne anunțați imediat ce ați observat orice folosire neautorizată a contului dumneavoastră.

Nu puteți folosi un nume de utilizator al unei alte persoane sau entități sau un nume de utilizator care nu este disponibil in mod legal, un nume sau un brand a cărui folosire este restricționată unei alte persoane sau entități sau un nume care poate fi considerat vulgar sau obscen.

Utilizarea contului nominal

La crearea contului, Utilizatorul se obligă că (i) se va deregistra din contul nominal la orice încetare a utilizării Serviciilor și (ii) va informa de îndată Furnizorul cu privire la orice accesare neautorizată a contului său nominal sau orice alt eveniment similar de care ia cunoștință sau pe care îl suspectează. În măsura maxim permisă de legislația aplicabilă, răspunderea Furnizorului va fi exclusă pentru prejudicii sau daune de orice natură suportate în legătură cu orice încălcare de către utilizator a obligațiilor sus-menționate.

Înscrierea la unul sau mai multe cursuri

Pentru evitarea oricăror dubii, înscrierea la oricare dintre cursuri este posibilă exclusiv prin utilizarea contului nominal și este supusă în mod obligatoriu unei aprobări prealabile, în scopul verificării îndeplinirii condițiilor de înscriere și a disponibilității cursului respectiv.

Nicio înscriere nu produce efecte până la momentul primirii de către solicitant a unei confirmări scrise atestând validarea înscrierii.

Un utilizator se poate înscrie la mai multe cursuri simultan.

Accesarea materialelor de curs

Orice utilizator înscris la un anumit curs poate accesa oricare dintre materialele disponibile pentru cursul respectiv în orice moment pe durata acestuia, cu condiția ca accesarea să nu se realizeze în același timp de la mai mult de un echipament (sistem hardware, telefon, tabletă sau altele asemenea).

Retragerea de la curs

Orice utilizator se poate retrage în orice moment de la oricare dintre cursurile la care i-a fost validată înscrierea. Pentru evitarea oricăror dubii, utilizatorul va suporta orice costuri legate de retragerea de la oricare dintre cursuri, neavând dreptul la restituirea taxelor de înscriere achitate decât dacă dovedește că nu a accesat nici unul dintre materialele de curs disponibile pentru cursul respectiv.

Revocarea de către Furnizor a drepturilor utilizatorului de a accesa cursul respectiv

Încălcarea de către utilizator a oricăreia dintre Termeni si Condiții dă dreptul Furnizorului de a revoca drepturile utilizatorului de a accesa oricare dintre cursurile la care este înscris.

Dezactivarea contului nominal

Utilizatorul poate parcurge în orice moment etapele necesare dezactivării contului său nominal. Încălcarea de utilizator a oricăreia dintre prezentele Condiții Generale dă dreptul Furnizorului de a dezactiva contul nominal al utilizatorului respectiv.

Înscrierea la orice curs efectuată anterior dezactivării contului nominal rămâne fără efecte, utilizatorul pierzând dreptul de a accesa sau utiliza oricare dintre Serviciile care presupun accesarea contului nominal. Pentru evitarea oricăror dubii, utilizatorul va suporta orice costuri legate de dezactivarea contului nominal, neavând dreptul la restituirea taxelor de înscriere achitate.

Creating a nominal account

Prior to subscribing to any of the courses, a nominal account for using the Services shall be created and secured by a password as chosen by the user.

For creating a nominal account, the user declares, guarantees and undertakes that he complies with the following requirements:

a)     he is over18 years old;

b)    he has used, for creating the nominal account, complete and accurate identification data and he undertakes to notify the Provider with respect to the amendment of any of this data;

c)     the e-mail address declared to create the account is not used by any third party

d)    the e-mail address declared to create the account is personal and no other party has access to it.

e)    he will not upload, promote or otherwise transfer, by means of the Services, any kind of unrequested messages or commercial communications nor any other kind of commercial offer;

f)      he will not draft or otherwise deliver any kind of offending, racist, fake, misleading, defamatory messages or similar;

g)     he will keep confidential the login data and he will not ease an unauthorized access of any other person to any of the Services;

h)    he will not introduce neither any virus nor any other similar technology which may or is designated to prejudice the good functioning of the Services or of any other hardware or software resources of the Provider or of other users.

Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You will notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Use of nominal account

The user is exclusively liable for keeping confidential the nominal account and its related password, as well as for all the activities performed through or by using in any way the nominal account.

By creating his nominal account, the User undertakes (i) to log out of the nominal account each time he ceases to use the Services and (ii) to immediately inform the Provider with respect to any unauthorized access of his nominal account and to any other similar event acknowledged or suspected by him. To the maximum extent allowed under applicable law, Provider’s liability shall be precluded for prejudices or damages of any kind borne in connection with any breach of the above-mentioned obligations by any user.

Enrollment to one or several courses

To avoid any doubt, subscription to any of the courses is permitted exclusively by using the nominal account and is mandatorily subject to a prior approval in order to verify the fulfilment of the subscription requirements and the availability of such course.

No subscription shall become effective until a written confirmation attesting the validation of the respective subscription is received by the applicant.

Any user may simultaneously subscribe to several courses.

Access the course material

Any user subscribed to a certain course may access any materials available for the respective course at any moment during the course provided that such access will not be done from more than one device simultaneously (hardware system, phone, pad or any other similar device).

Any user who subscribed to a certain course may access any materials available for such course at any moment during the respective course, until the withdrawal of the user from such course or until revocation by the Provider of the user’s rights to access such course.

Withdrawal from a course

Any user may withdraw at any moment from any of the courses to which its subscription has been validated. For the avoidance of any doubt, the user shall borne any and all costs related to his withdrawal from any of the courses, without he being entitled to reimbursement of paid subscription fees unless he proves that he has not accessed any of the course materials available for such course.

Cancelation by the Provider of the user’s rights to access a course

Any breach by the user of any of Terms and Conditions entitles the Provider to revoke the user’s rights to access any courses to which he is subscribed.

Disabling the nominal account

The user may undertake at any moment the steps necessary for deactivating his nominal account. Any breach by the user of any of these General Conditions entitles the Provider to deactivate the nominal account of such user.

Subscription to any course done prior to deactivating a nominal account shall remain ineffective, the user thereby losing the access and use rights of any of the Services involving the access of a nominal account. For the avoidance of any doubt, the user shall borne any costs related to deactivation of his nominal account, without he being entitled to the reimbursement of paid subscription fees.
